Voyage Charter A voyage charter is the hiring of a vessel and crew for a voyage between a load port and a discharge port. The charterer pays the vessel owner on a per-ton or lump-sum basis. The owner pays the port costs (excluding stevedoring), fuel costs and crew costs. The payment for the use of the vessel is known as freight. A voyage charter specifies a period, known as laytime, for unloading the cargo. If laytime is exceeded, the charterer must pay demurrage. If laytime is saved, the charter party may require the shipowner to pay despatch to the charterer. The commercial operator will operate the vessel on a voyage charter and relay specific instructions from the Charterer to the Master. These instructions must be followed exactly, unless there is any safety or operational restrictions, in which case the commercial operator and/or DPA should be consulted immediately. If the ship is chartered entirely , the agreement will usually be noted by a charter party , although , under certain legislations , this agreement may also be materialized by other means , even by testimony. Usually , under voyage charter both fixed costs and the variable costs are at the expense of the ship owner.In the contract of affreightment it is clearly stipulated who must pay the cargo handling cost. Time Charter We hire a vessel for for a specific period of time;select the ports and direct the vessel where to go;pay for all fuel the vessel consumes including port charges and a daily ''hire'' to the owner of the vessel while the owner manages the vessel. The time charter is a contract for the hire of a named vessel for a specified period of time,during which time he may use the vessel as he wishes (exceptions considered of course). The time during which the ship is chartered differs from contract and can amount to several months or years , i.e. the period time charter ; or only amount to the time that is necessary to undertake one complete voyage , i.e. the trip time charter. Under the period time charter , the charterer c an make as many trips during that period with the ship as he possibly can. Under the trip time charter , only a single trip can be made just as under a voyage charter but a time charter conditions. Under a time charter ship owner is only responsible for the nautical and technical operation of the shipo whereas the charterer (in fact the time charter) is responsible for the commercial operation of the ship.It follows that under a time charter , the fixed costs of the ship are for the account of the owner and the variable costs are for the account of the time charterer.With a traditional time charter the time charterer will hire the ship equipped and manned. Bareboat & Demise Charter A bareboat charter is an arrangement for the chartering or hiring of a ship or boat, whereby no crew or provisions are included as part of the agreement; instead, the people who rent the vessel from the owner are responsible for taking care of such things. There are legal differences between a bareboat charter and other types of charter arrangement, commonly called time or voyage charters. In a voyage or time charter the charterer charters the ship (or part of it) for a particular voyage or for a set period of time. In these charters the charterer can direct where the ship will go but the owner of the ship retains possession of the ship through its employment of the master and crew. In a bare-boat or demise charter, on the other hand, the owner gives possession of the ship to the charterer and the charterer hires its own master and crew. The bare-boat charterer is sometimes called a "disponent owner". The giving up of possession of the ship by the owner is the defining characteristic of a bare-boat or demise charter. In a bareboat charter no administration or technical maintenance is included as part of the agreement. The charterer obtains possession and full control of the vessel along with the legal and financial responsibility for it. The charterer pays for all operating expenses, including fuel, crew, port expenses and P&I and hull insurance. A demise charter is a form of bareboat charter in which the charter period may last for many years; and may end with the charterer acquiring title (ownership) of the ship. In this case, a demise charter is a form of hire-purchase from the owners, who may well have been the shipbuilders. Demise chartering is common for tankers and bulk-carriers.
